1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the SongsSmith website and services (“Services”). SongsSmith (“SongsSmith,” “we,” “us,” or “our”) provides personalized custom song creation services based on information submitted by customers.
By accessing our website, submitting a song request, or purchasing any service, you confirm that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree to these Terms, you must not use our Services.
2. Description of Services
SongsSmith creates original, customized musical compositions based on personal stories, instructions, and creative preferences submitted by customers. All songs are custom-made digital products intended for personal use unless otherwise agreed in writing.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.
3. Eligibility
By using our Services, you represent that you are at least 18 years of age and legally capable of entering into a binding agreement. Our Services are not intended for minors, and we do not knowingly provide services to individuals under the age of 18.
4. Orders and Payment
When placing an order, you agree to provide accurate and complete information. All payments must be made in full at the time of purchase unless otherwise stated. Payments are processed securely through Stripe, a PCI-DSS compliant third-party payment processor. SongsSmith does not store, access, or retain full credit or debit card details.
By submitting payment information, you represent that you are authorized to use the payment method provided. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, misuse, or violation of these Terms.
5. Order Cancellation Window
Customers may cancel their order within 12 hours of placement for a full refund, provided that creative production has not yet commenced. Once our team begins writing, composing, or producing your custom song, the order is no longer eligible for cancellation.
To request a cancellation, contact us at support@dev.songssmith.com as soon as possible with your order reference. Cancellation requests submitted after the 12-hour window or after production has started will not be eligible for a refund.
6. Custom Nature of Services
All SongsSmith products are personalized custom creations. You acknowledge that each song is uniquely developed based on your submitted details and creative brief. Because of the artistic and customized nature of our Services, final results may vary based on creative interpretation.
SongsSmith does not guarantee similarity to any specific artist, commercial song, or copyrighted work.
7. Revisions
Revision opportunities are governed by the package selected at the time of purchase. Revisions are limited to minor adjustments such as small lyric modifications, slight vocal changes, or subtle shifts in tone or pacing.
Revisions do not include full rewrites, new concepts, or genre changes unless otherwise agreed. Excessive or unreasonable revision requests may be declined or may require additional fees.
8. Intellectual Property Rights
All songs, lyrics, compositions, instrumentals, and related materials created by SongsSmith remain the intellectual property of SongsSmith unless otherwise explicitly agreed in writing. Upon full payment, you are granted a personal, non-exclusive, non-transferable license to use the custom song for personal, non-commercial purposes.
Commercial use, redistribution, resale, or public performance rights require a separate written agreement. SongsSmith retains the right to use instrumental portions or anonymized excerpts for internal portfolio purposes unless otherwise agreed in writing.
9. Customer Responsibilities
You are responsible for ensuring that all information submitted is accurate and that you have the legal right to provide any personal details, names, or materials included in your song request. You agree not to submit content that is unlawful, defamatory, abusive, infringing, or otherwise inappropriate.
SongsSmith reserves the right to refuse service for requests that violate applicable laws or ethical standards.
10. Limitation of Liability
To the fullest extent permitted by law, SongsSmith shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our Services. Our total liability for any claim related to your purchase shall not exceed the amount paid for the specific service in question.
Because our Services are creative and subjective in nature, dissatisfaction based solely on artistic preference does not constitute a breach of contract.
11. Digital Delivery
All songs and related materials are delivered digitally to the email address provided at checkout. Once delivered, the order is considered fulfilled. SongsSmith is not responsible for delivery failures caused by incorrect contact information provided by the customer.
Customers are responsible for checking their spam or junk folders if a delivery is not received within the stated timeframe.
12. Payment Disputes & Chargebacks
We strongly encourage customers to contact us directly at support@dev.songssmith.com before initiating any dispute with their payment provider. Most concerns — including quality issues, delivery problems, or revision disagreements — can be resolved promptly through direct communication.
Customers who initiate a chargeback or payment dispute after receiving a fully delivered custom song, without first attempting to resolve the issue with our support team, may have their dispute contested with evidence of completed work and delivery confirmation. We reserve the right to restrict future service to customers who engage in repeated or bad-faith payment disputes.
13. Third-Party Services and Links
Our website may contain links to third-party websites or services. SongsSmith is not responsible for the content, policies, or practices of third-party providers, including Stripe. Your interactions with third-party services are governed by their respective terms and privacy policies.
14. Termination
We reserve the right to suspend or terminate access to our Services at our discretion if we believe these Terms have been violated or if misuse is suspected. Termination does not relieve you of any outstanding payment obligations.
15. Governing Law
These Terms shall be governed and interpreted in accordance with the laws of the United Kingdom (or the applicable jurisdiction in which SongsSmith / Solid Stone Ventures is registered), without regard to conflict of law principles. 16. Dispute Resolution
In the event of any dispute arising from these Terms or your use of our Services, both parties agree to first attempt resolution through good-faith communication. 17. Changes to These Terms
SongsSmith may update or revise these Terms at any time. Changes will be effective upon posting with an updated Effective Date. Continued use of the Services after updates constitutes acceptance of the revised Terms. We recommend checking this page periodically.
